Habitly Terms and Conditions of Use

1. Acceptance of Terms
By downloading, installing, or using the Habitly application ("the Application"), you agree to be legally bound by these Terms and Conditions. If you do not agree with these terms, do not use the Application.
2. Service Description
Habitly is a mobile application designed to help users:
- Create and track personal habits on a daily, weekly, or custom frequency
- Maintain completion streaks and protect them with Freeze Days
- Participate in a private gamification system (XP, levels, achievements)
- Receive personalized reminders on a daily, weekly, or custom schedule
- Visualize progress through heatmaps and statistics, and export data in CSV or PDF format
- Optionally access premium features through a subscription or one-time purchase
Habitly does not include public social features (no friends, group challenges, or leaderboards). The entire experience is individual.
3. Registration and User Account
3.1 Registration Requirements
To use Habitly, you must:
- Be at least 13 years of age (or the higher minimum age required by local law, for example 16 in certain European Union countries)
- Provide truthful and up-to-date information
- Maintain the confidentiality of your access credentials
3.2 Account Responsibility
You are responsible for:
- All activity conducted under your account
- Keeping your password secure
- Notifying us immediately of any unauthorized use
3.3 Registration Methods
You can register using:
- Email and password
- Google Sign-In
- Guest Mode (without full registration)
3.4 Guest Accounts
Habitly offers a guest mode that lets you explore the application without full registration. Guest accounts have the following characteristics:
- Habit limit: Maximum of 5 active habits.
- Preserved data: Your habits, logs, XP, achievements, and freeze days are saved on the server associated with a guest token.
- Migration: You can convert your guest account to a full account (email/password or Google) at any time, keeping all your progress.
- No email required: You only need a username.
- Limited persistence: If you lose your guest token (for example, by uninstalling the application or switching devices without migrating first), the associated progress may not be recoverable.
When migrating to a full account, all your guest data is transferred automatically.
4. Acceptable Use
4.1 You Agree To:
- Use the Application only for personal, non-commercial purposes
- Provide accurate information in your profile
- Comply with all applicable laws and regulations
4.2 You Must Not:
- Create fake accounts or multiple accounts to circumvent service limits
- Share your credentials with third parties
- Attempt to access other users' accounts or data you are not authorized to access
- Use the Application for illegal or fraudulent activities
- Manipulate the gamification system (XP, levels, achievements, freeze days) fraudulently, including through reverse engineering or API request forgery
- Attempt to hack, decompile, reverse-engineer, or modify the Application
- Use bots, scrapers, or automated scripts to interact with the service
- Interfere with server operation or bypass rate-limiting mechanisms
5. User Content
5.1 Ownership
You retain ownership of the habits, names, and data you enter into the Application.
5.2 Limited License
By using the Application, you grant us a limited license to store and process your content for the sole purpose of providing the service.
5.3 Responsibility
You are responsible for the content you enter, including habit names, goals, custom motivational quotes, and any other text you introduce into the Application. You must not enter content that infringes third-party rights, is illegal, or is inappropriate.
6. Gamification System
6.1 Experience Points (XP)
- XP is awarded for completing habits and achievements
- XP determines your level within the Application
- XP has no real monetary value
6.2 Freeze Days
- Freeze Days protect your streak when you cannot complete habits
- They are awarded on registration (2 freeze days) and upon reaching each 5-level milestone: 3 per milestone for free users, 5 per milestone for premium users
- Premium users additionally receive 5 freeze days automatically every 30 days while their subscription is active
- They are non-transferable and non-refundable
6.3 Achievements and Levels
- Achievements are unlocked by meeting specific conditions
- Levels reflect your progress within the Application
- They do not grant any benefits outside the Application
7. Premium Subscriptions and Payments
7.1 Available Plans
Habitly offers optional premium features through the following plans, whose prices are displayed on the in-app paywall:
- Monthly: Recurring subscription with automatic monthly renewal.
- Yearly: Recurring subscription with automatic yearly renewal. New subscribers receive a 5-day free trial; you will not be charged during the trial period, and the subscription will begin automatically at the end of the trial unless you cancel before it ends.
- Lifetime: One-time purchase with no renewal.
An active premium plan unlocks the following features:
- Unlimited habits (the 5-habit cap that applies to free and guest accounts is removed)
- Full access to statistics, insights, and trend analysis
- Android home-screen widgets (today's habits list and streak heatmap)
- Custom reminder messages per habit
- Custom motivational phrases
- 5 freeze days per 5-level milestone (vs. 3 for free users), plus 5 additional freeze days every 30 days while the subscription is active
The set of premium features may evolve over time; see section 7.5.
7.2 Payment Processing
All purchases and subscriptions are processed through Google Play Billing and are subject to Google Play's terms. Habitly does not process or store card data, bank account information, or any payment details.
7.3 Renewal and Cancellation
- Subscriptions renew automatically at the price in effect at the time of renewal, unless you cancel before the end of the current period.
- You can cancel your subscription at any time from Google Play → Payments & subscriptions → Subscriptions.
- If you cancel during the 5-day free trial, you will not be charged and premium access ends when the trial period ends.
- When you cancel a paid subscription, you retain premium access until the end of the period already paid for.
7.4 Refunds
Refund requests are handled in accordance with Google Play's refund policies. Habitly does not issue direct refunds; where permitted by applicable law, you may request a refund through Google Play.
EU and UK consumers: If you reside in the European Union, United Kingdom, or another jurisdiction granting a statutory withdrawal right, you normally have 14 days to withdraw from a digital purchase. By starting to use the premium features immediately upon purchase, you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal, as permitted by Article 16(m) of Directive 2011/83/EU. All other refund requests are handled exclusively through Google Play.
7.5 Price and Premium Feature Changes
We may modify the set of premium features or plan pricing. Price changes will not affect subscriptions already paid for within the current period, and we will notify you with reasonable advance notice before the next renewal.
7.6 Data Export
The Application lets you export your habits and log history in CSV or PDF format from Settings → Export Data. Generated files are saved locally on your device and can be shared through the system share sheet. You are solely responsible for the subsequent use and distribution of these files.
8. Intellectual Property
8.1 Our Property
Habitly and all its content, including but not limited to:
- Application design and code
- Logos and trademarks
- Icons and graphics
- Gamification system
Are the exclusive property of Habitly and are protected by intellectual property laws.
8.2 Restrictions
You may not copy, modify, distribute, sell, or rent any part of the Application without express written authorization.
9. Service Availability
9.1 No Availability Guarantee
- We strive to keep the Application available 24/7
- We do not guarantee uninterrupted availability
- We may perform maintenance without prior notice
9.2 Modifications
We reserve the right to:
- Modify or discontinue features
- Update the Application
- Change technical requirements
10. Limitation of Liability
10.1 The Application Is Provided "As Is"
Habitly is provided without warranties of any kind, either express or implied.
10.2 Exclusion of Damages
We will not be liable for:
- Loss of data or progress
- Service interruptions
- Indirect or consequential damages
- Losses arising from use of the Application
10.3 Maximum Limit
In no event shall our total liability exceed the amount you have paid for the service (if applicable), or zero in the case of free services.
11. Termination
11.1 By the User
You may stop using the Application at any time and request deletion of your account from Profile → Settings → Delete Account.
11.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms and Conditions
- Engage in fraudulent activity
- Abuse other users
- Attempt to manipulate the system
11.3 Effects of Termination
Upon account termination:
- You will lose access to the Application and the content associated with your account.
- Your data will be permanently deleted (user, habits, logs, XP, level, achievements, freeze days, quote preferences, and onboarding), except for data we are required to retain by legal obligation.
- Active premium subscriptions continue to be managed through Google Play; any refunds are subject to Google Play's policies and applicable law.
12. Indemnification
You agree to indemnify and hold harmless Habitly, its developers, and affiliates from any claim, damage, loss, or expense arising from:
- Your use of the Application
- Your violation of these terms
- Your violation of third-party rights
13. Disputes and Governing Law
13.1 Governing Law
These terms are governed by the laws of Mexico.
13.2 Dispute Resolution
Any dispute will be resolved through:
- Direct good-faith negotiation
- Mediation (if negotiation fails)
- Jurisdiction of the competent courts
14. Changes to the Terms
- We may modify these terms at any time
- Significant changes will be notified within the Application
- Continued use after changes constitutes acceptance
15. General Provisions
15.1 Entire Agreement
These terms constitute the entire agreement between you and Habitly.
15.2 Severability
If any provision is invalid, the remaining provisions remain in effect.
15.3 Waiver
Failure to exercise a right does not constitute a waiver of that right.
15.4 Assignment
You may not assign your rights under these terms without our consent.
